False Claims Act/Qui Tam

To help prevent fraud and punish improper use of government funds, the federal government enacted the False Claims Act. Under this act, a whistleblower may file what is known as a “qui tam claim” on behalf of the government. This alerts the government of the fraud and triggers an investigation into the misconduct. Any entity that is a party to a government contract — typically a contract where they receive funds from the government — can be held accountable through a qui tam claim under the False Claims Act.

Qui tam claims address a wide range of circumstances and situations involving the defrauding of the U.S. government. This can include:

  • Medicare fraud
  • Medical billing fraud
  • Medical providers receiving kickbacks to recommend particular products (in violation of the Anti-Kickback Statute)
  • Misuse of government funds by defense contractors
  • Securities fraud
  • Tax fraud
  • Customs and shipping fraud
  • Concealing information related to a government contract

A successful qui tam action can result in the offending party being forced to pay triple the amount of money it defrauded from the government and allows the whistleblower to receive a percentage of the compensation recovered.
