Unpaid Time (Off-The-Clock Hours)

Has an employer asked you to put in a few hours "off the clock" or carry out your job without pay? Has your employer gone so far as to threaten termination of your employment if you do not put in these off-the-clock hours? In these situations, or anytime you put in more than 40 hours per week, there are legal protections in place to ensure that you are paid for all the hours you work.

Fair Labor Standards Act (FLSA)

The Fair Labor Standards Act (FLSA) requires that employees (who are not salaried or considered exempt) be compensated for all of the time they work. When those hours go beyond a typical 40-hour workweek, the FLSA also requires that employees receive overtime wages that are at least 1½ times their typical hourly pay.

What To Do If You Have Been Required To Work Off The Clock

All too often, employers attempt to get free work from their employees. Whether they ask you to "just spend an hour or two finishing up" or to "have the project done by Monday, no matter how long it takes," if you are an hourly employee, your employer must pay you for each hour worked. When this does not happen, you can assert your rights through the legal process and seek to recover the full compensation you are owed by your employer. As soon as possible, seek legal counsel who can guide you through all of the steps necessary to put your case in the strongest position possible.
